legal memory 〈英〉法律追溯日;法律追忆期 在英格兰法中指理查一世〔Richard Ⅰ〕登基之日,即1189年9月3日,一说为1189年7月6日,因为依据1275年的《威斯敏斯特法Ⅰ》〔Statute of Westminster Ⅰ〕,1189年为依权利令状主张地产权利的限期。在普通法上,时效取得是建立在一种推定的授权之上的,即法律假定事实上的和平占有持续一定时间即赋予当事人合法的权利,如同经过正式授权一般。依时效而成就的地役权须证明以某一时刻——通常是法律追溯日起,该地役权就为当事人所享有,而在从法律追溯日到现在这一段时间内无否定当事人享有该地役权的相反证据,则该地役权推定为由该当事人享有。但在实践中,如果有证人证明在其记忆中当事人已享有某种权利,同时亦无相反证据证明这种享有始自1189年乃不可能,则法庭是很乐意将这种权利的享有推定为始于1189年的。
